Terms and Conditions

Gift of Go reserves the right to update or revise the Terms & Conditions without prior notice. The latest version of the Terms & Conditions can always be found on our website.

We recommend that you carefully review these Terms & Conditions before making a reservation with Gift of Go. These Terms & Conditions form a contractual agreement between Gift of Go Expeditions LLC, a Texas-based LLC, with its principal offices at 1321 Upland Dr. PMB 10502 Houston, Texas 77043 (referred to herein as “GOGO”), and the Client, effective from the moment the booking is confirmed. The person making the reservation is responsible and aware of and complies with these conditions and is liable for all payments due. By purchasing any travel services from GOGO, the Client agrees to be bound by these Terms and Conditions, which constitute a contractual arrangement between the Client and GOGO.

1) GUARANTEED DEPARTURES

GOGO guarantees that all non-Bespoke Small Group Expeditions featured within its Collections will proceed with a minimum of two (2) persons, unless otherwise specified in the itinerary. Guaranteed departures are subject to cancellation only in the event of force majeure, which may include any major world event that negatively impacts international travel patterns or other circumstances beyond GOGO’s control.

2) INCLUDED IN COLLECTIONS & BESPOKE

All personnel, transportation services, accommodations, meals, equipment, sightseeing entrance fees & permits (to Parks, festivities, etc.) as described in the itinerary; airport transfers to/from accommodations in the first/last published city; and non-alcoholic beverages at included meals.

3) NOT INCLUDED IN COLLECTIONS & BESPOKE

International and internal airfares, unless otherwise noted; costs associated with obtaining passports or entry visas; reciprocity and other border fees; airport departure taxes, unless otherwise noted; excess baggage charges; meals other than those specified in the itinerary; room service; alcoholic beverages; sightseeing not included in the published itinerary; personal expenses, communication charges; optional activities (which are subject to availability); and gratuities.

4) SPECIAL REQUESTS

All special needs and requests, including any dietary restrictions, private accommodations preferences, and similar, should be advised at the time of booking. Please note that reasonable efforts will be made to secure special requests; however, they cannot be guaranteed.

5) ALTERATION IN ITINERARYS

GOGO reserves the right to make changes to the itinerary for any reason, including but not limited to unfavorable weather, road and trail closures; Park & accommodations closures; injuries to personnel; logistical challenges; and unfavorable community developments; as well as favorable alternatives, including but not limited to local events; restaurant & accommodations openings; new road and trail openings; and new favorable routes & opportunities; as determined solely by GOGO and subject to supplier terms and conditions. In the event that a property, supplier, activity, or area is removed for any reason, GOGO may at its sole discretion replace it with an alternative that it deems suitable.

6) AIR TRANSPORTATION FOR COLLECTIONS

Please note that for all expeditions occurring in Minas Gerais, it is mandatory that you arrive at Aeroporto Internacional de Confins / Tancredo Neves on the initial date and time specified in the itinerary. GOGO cannot be held responsible for any delays that may result from missed pickups. In the event of a missed pickup, GOGO may at its discretion arrange for an alternative vehicle and driver to collect you from the airport, which will be subject to additional fees. Should GOGO determine that it cannot delay its itinerary due to either the participation of other travelers or logistical or cost-related repercussions stemming from such delay, it will continue with its itinerary and arrange for the traveler to meet us at the earliest opportune time.

7) BAGGAGE

GOGO shall not be responsible for any information regarding passengers’ baggage that is not within its control, including but not limited to baggage that is transported on the plane en route to the rendezvous point, and alternative vehicles requested by travelers.

Any baggage and/or belongings left behind by travelers following the expedition should be communicated promptly to GOGO, which will make every reasonable effort to locate and deliver the baggage/belongings to the traveler, subject to additional fees & taxes. However, GOGO shall not be liable for any baggage and/or belongings left behind by travelers.

8) PRICES AND ARRANGEMENTS

The prices quoted for the expedition are on a per-person basis, based on double occupancy, unless otherwise indicated. While we do not anticipate any changes to published prices, unforeseen and significant external factors may require us to adjust the pricing. GOGO is not required to provide a breakdown of costs for any expedition. Any adjustments made to our itinerary in order to accommodate a smaller group size will not impact the published program price.

9) CHILD POLICY

The minimum age requirement for all non-Bespoke GOGO Small Group Expeditions is 25 years old due to the required mindset for participation.

10) ACTIVE ELEMENTS & CONDUCT

To fully participate in GOGO expeditions, a certain level of fitness is required. If any traveler has a physical or other condition or disability that could prevent them from engaging in active elements of any expedition and/or may pose a hazard to themselves or other members of the group, GOGO must be notified in advance. Prior to travel, we require that participants produce a doctor’s certificate attesting to their adequate health for the expedition.

GOGO will make every reasonable effort to accommodate disability-related requests. However, if at its sole discretion GOGO is unable to accommodate the needs of the person(s) concerned or believes that the health and safety of either that individual or that of other travelers or our crew could be jeopardized, GOGO reserves the right to deny participation. The traveler guarantees that neither they nor anyone accompanying them have any physical or other condition or disability that could create a hazard to themselves or other members of the expedition. 

GOGO retains the right to remove any traveler, at their own expense, whose physical condition or behavior, whether willful or unwillful, negatively impacts the enjoyment of other guests or disrupts the expedition.

11) CLIENT INSURANCE

IIn order to participate in any of our expeditions, it is mandatory for travelers to obtain, provide, and maintain proof of valid travel insurance. The price of our expeditions does not include travel insurance. It is the responsibility of each traveler to purchase a travel insurance policy that provides coverage suitable for the nature of the activities included in the expedition. Failure to provide proof of travel insurance may result in the traveler being denied participation in the expedition without any right to a refund or credit.

12) STANDARD OF BEHAIVIOR

On a GOGO expedition, all travelers are expected to maintain high standards of honor, morality, integrity, and respect. GOGO leaders and staff have the sole discretion to remove, without any right to refund or credit, any participant from an expedition if they are perceived to be dangerous to themselves or another traveler, community member, or staff. A traveler will be removed, without any right to refund or credit, if believed to present a safety concern, medical risk, behavior problem, engage in illegal activity, or anything else the staff determines is detrimental to the course.

13) PASSPORTS AND VISAS

It is the sole responsibility of the traveler to obtain and maintain the necessary valid travel documents required for their travel, and to have them available at all times as required, including any documentation required by GOGO as per our Expedition Document Checklist. GOGO advises all travelers to check with the relevant government authority to determine the necessary documents required for their travel. For international destinations, all U.S. citizens are required to possess a valid passport that must remain valid for six (6) months beyond the completion of their journey. Passports must also have sufficient blank visa pages for entry and exit stamps. 

If a traveler fails to possess proper documentation, GOGO reserves the right to cancel the participation of that traveler without any liability for refund, payment, compensation, or credit of any kind. Any fines or costs incurred by GOGO due to improper documentation or noncompliance with applicable regulations will be the responsibility of the traveler. GOGO shall not be held responsible if a traveler is denied entry into a country due to noncompliance with the above-mentioned requirements.

14) RESERVATION AND PAYMENT SCHEDULE

By making any payment to GOGO, you hereby accept and agree to be bound by the terms and conditions set forth in this agreement and in your Pre-Travel Documentation. Such acceptance shall be deemed to have occurred at the time of payment.

Payment Schedule for Diamonds/Wild Tales + Lost Trails Expeditions

181 days or more prior to departure - $1,000.00 (upon making Reservation; this is non-refundable) + 25% of Expedition price (within 30 days of making Reservation)

180 - 121 days prior to departure - 50% of Expedition price

120 days prior to departure - 100% of the Expedition price

The full balance of your payment and a signed Participant Agreement are both due 120 days before the departure date. If you are reserving your trip within 120 days of departure, full payment is required at the time of reservation. The Participant Agreement, which will be sent to you in your booking confirmation email, contains additional terms and conditions of travel, including limitations on our obligations to you.

Payment Schedule for Beskpoke trips

211 days or more prior to departure - $2,000.00 (upon Reservation; this is non-refundable) + 25% of Expedition price (within 15 days of Reservation)

210 -151 days prior to departure - 50% of Expedition price

180-150 days prior to departure - 100% of the Expedition price

Payment Options

At Gift of Go we've made paying us easy and direct. If you'd like to avoid a transaction fee, you can pay GOGO by check, debit card or ACH/Wire payment. If you choose to pay by a credit card, please note that a 2.5% processing fee will be assessed for all credit card transactions.

Please inform us of your preferred method, and we will gladly provide all necessary information.

15) CANCELLATION CHARGES

Cancellations will be effective on the date of receipt by GOGO whether by phone, email or fax. Cancellations received by GOGO are subject to the following:

120-90 days prior to departure - 50% of Expedition price

90 days prior to departure or less - 100% of the Expedition price

Cancellation for Bespoke Trips

211 days prior to departure or more - $2,000 (non-refundable reservation deposit)

210-181 days prior to departure - 20% of Expedition price

180-121 days prior to departure - 50% of Expedition price

120 days prior to departure or less - 100% of the Expedition price

The traveler hereby acknowledges and agrees that the sums referenced in the cancellation provisions outlined above do not constitute a penalty, but rather represent a reasonable estimate of GOGO's potential loss and damages resulting from cancellation. These liquidated damages include, but are not limited to, fees charged by hotels and travel suppliers to GOGO for canceled bookings. The traveler acknowledges that such damages are difficult to ascertain at the time of cancellation and that these provisions serve to establish a fair and reasonable compensation for the loss suffered by GOGO. The guest further agrees that such sums shall be payable by the guest upon cancellation in accordance with the terms and conditions of this agreement.

16) FORCE MAJEURE

Force majeure refers to any exceptional and unforeseeable circumstances beyond the control of GOGO or its suppliers, the consequences of which could not have been avoided even with all due care. Such circumstances include, but are not limited to, war or threat of war; riot, civil strife, or terrorist activity (actual or threatened); industrial disputes; technical problems with transport, machinery or equipment; outages or power failures; natural or nuclear disaster; fire, flood, drought or adverse weather conditions; hazardous road, trail, river, and other logistical conditions; land disputes; pandemics, epidemics, or outbreaks of illness; and conditions in oceans and level of water in rivers.

If the circumstances described in this clause result in the cancellation or material alteration of the journey, GOGO may, at its sole discretion:

(i) Offer alternative travel arrangements or products of comparable quality and value, as appropriate in the circumstances; or

(ii) If GOGO is unable to offer alternative travel arrangements or products, provide a travel credit to the traveler(s) equal to the value of the trip, less any sums that GOGO is not able to recover from any supplier.

GOGO shall not be responsible for any other travel-related costs incurred by the traveler, including but not limited to airfare, insurance, visas, and other travel arrangements.

17) HEALTH

By submitting a deposit for your trip and completing your Traveler Information Form, you attest that you are free from any physical or mental ailment or disability that could pose a threat to your safety or the safety of other travelers. Additionally, you confirm that you have obtained all necessary and applicable vaccinations as per the requirements of the country(ies) you are traveling to. We recommend you to consult with your physician regarding the same.

We retain the right to amend any trip and its corresponding activities, as necessary or advisable, taking into consideration i) any physical, mental, or emotional disability, condition, limitation, or ability that you have notified us of; or ii) any health and safety concerns arising from local circumstances. You acknowledge that if you choose not to inform us of any physical, mental, or emotional ailment, limitation, or ability, or vaccination status, we may not be able to fully accommodate you on all aspects and features of your trip.

Each traveler is responsible for carrying and providing proof of vaccination, testing, medical insurance, and any other government-mandated documentation required by local authorities in the country(ies) of destination. It is your responsibility to stay informed of and adhere to all applicable requirements and laws, which are subject to change frequently and rapidly. 

18) CLAIMS AND REFUNDS

GOGO hereby disclaims any and all liability for any and all claims, and shall not provide refunds, except to the extent specifically permitted in this agreement. The traveler acknowledges and agrees that GOGO shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from or related to any aspect of the traveler’s participation, including but not limited to, cancellation, delay, loss, theft, injury, illness, or death. The traveler further agrees to indemnify and hold harmless GOGO and its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from or related to the traveler’s participation, including but not limited to, any claims by third parties. The guest acknowledges and agrees that any refunds provided by GOGO shall be made in accordance with the terms and conditions of this agreement and shall be subject to any applicable cancellation fees or other charges.

19) LIMITS ON GOGO’S RESPONSIBILITY

The GOGO Parties shall not be held responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property arising from the provision of any goods or services, whether caused by acts of God or force majeure, illness, disease, war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation, or failure of any transportation mechanism to arrive or depart on time.

Adventure travel of the type offered herein involves many inherent risks that can lead to illness, injury, or death. These risks are increased by the fact that such trips take place in remote locations, often far from medical facilities. By participating in these trips and any activities offered therein, guests assume all risks associated therewith.

In the event that travelers choose to participate in any activities that may involve inherent risks, including any activity that GOGO deems to carry inherent risk of serious illness, injury, or death (“Activities”), they hereby acknowledge and fully understand that such Activities carry various inherent risks, including but not limited to serious illness, injury, or death. Travelers take full responsibility for their own health and safety and assume all risks of injury, illness, or death, whether foreseen or unforeseen, that may befall them as a result of participating in any Activities and agree to release the GOGO Parties from any liability whatsoever related thereto.

Moreover, travelers agree to release and waive any claims against the GOGO Parties, whether known or unknown, for property damage, cancellation of any Activities, illness, negligent rescue operations or procedures, personal injury, or death arising out of their participation in the Activities, including transportation to and from the site of the Activities, regardless of whether such property damage, illness, personal injury, or death results from the negligence of the GOGO Parties and/or from any defect in equipment. Travelers further agree to indemnify and hold the GOGO Parties harmless with respect to any claim made against the GOGO Parties by anyone else relating to their participation in any trip or any Activities, or which would be subject to the above release and covenant not to sue if guests had made the claim directly themselves. The GOGO Parties reserve the right to approve or withdraw approval of counsel in its sole discretion upon receipt of notice of the assertion of a claim.

20) PHROTOGRAPHS & VIDEOS

GOGO reserves the right to capture and use any photograph or video taken during any travel activity or event, without obtaining prior written permission from individuals featured in the media. GOGO may use these photographs or videos in various media publications or materials produced, used, or contracted by GOGO, including but not limited to brochures, invitations, books, newspapers, magazines, television, websites, and others. Individuals who do not wish to have their photograph taken or used in such media should contact GOGO in writing at info@thegiftofgo.com and provide a photograph along with their intentions.

21) NO COPYING OR EDITING

All content on this website is protected by copyright laws and may not be modified, copied, reproduced, republished, downloaded, posted, displayed, transmitted, performed, licensed, used to create derivative works, transferred, sold, or distributed without our prior written consent. Framing or mirroring any material from this website on any other server or location is also prohibited. Any unauthorized use of such materials on any other website, computer environment, or elsewhere is strictly prohibited.

22) PRIVACY POLICY

At all times your information will be treated in accordance with GOGO’s Privacy Policy, which is incorporated by reference into this Agreement and can be viewed at here.
